Can you file a mechanics lien?

We supplied material for a major job in California. A preliminary notice was filed in December 2021. Our customer has not paid the March and April invoices because they have not been paid by their customer. We are interested in filing a mechanics lien. Have we missed the deadline to file a lien?

The time for filing the mechanics lien depends upon the date of completion. All mechanics liens need to be filed within 90 days of completion, OR if a "Notice of Completion" is received, then within 30 days. If in doubt of the date of completion go by the date the final inspection passed. For many counties and cities this information is available online at the building department website.

You have 90 days to record a mechanics lien after the completion of the entire construction project, provided a Notice of Completion or Notice of Cessation of Work is not recorded. Liens should be filed promptly, so do not let the contractor string you along so you lose your lien rights!! When was the GC's work completed? After recording the lien you have 90 days to sue.
