Can we still enforce liem claim?

We passed the deadline for the reenforcement of this project, Sherlock Elementary School. Is it possible to still have the right to enforce it?

I'm unsure if you are referring to the Illinois mechanics lien filing deadline or the enforcement deadline; so I'll briefly tackle both.

IL lien filing deadline

There are technically two deadlines to file a lien claim in IL. If the claim is filed within 4 months after the completion of the entire project, the claim will provide full lien protection. However, a claim can be filed within 2 years of the project's completion but it will only be enforceable against the current owner, not any subsequent purchasers.

IL lien enforcement deadline

As for the deadline to enforce an Illinois mechanics lien, the clock begins to tick from the project completion. A claimant will have two years from that date to enforce their claim through a foreclosure action. Once this deadline passes, the claim will expire, and no longer be enforceable.
  • Note: the absolute deadline to file a claim is 2 years, as is the enforcement deadline; so both must be completed within that timeframe
