Can we lien this job?

We did not send out prelien for a job. Can we still file a lien? We were last on the job at around August 10 of 2022.

Depends on whether you're the general contractor or not and whether the job is still going. General contractors don't often have to file a prelien. But there's so nuance to it even then. Might be worth a call to a construction attorney to discuss you specific facts & options.

Bank Lien Bank lien is the lien which is often granted when the individual takes a loan from a bank to purchase an asset. For instance, you borrow a loan from a bank to buy yourself a car. The price of the car will be paid by the loan amount. This gives the bank the legal right to grant lien on the car.

Yes, you can still lien the job. The right to a mechanic’s lien is set forth in the California Constitution. You will need to serve your 20-day notice as usual, but your recovery will only sweep back to the date you served the 20-day notice. I believe that Levelset’s FAQ covers this issue if you need more information. Hope this helps.
