We provided material started work on a commercial project in California. Unfortunately we missed the 20 day deadline for filing the NTO. Can we file a late NTO and still be able to protect our lien rights?
I assume by NTO you mean 20 Day Preliminary Notice. You are allowed to give Preliminary Notice late. The late Preliminary Notice will protect your lien rights with respect to material provided 20 days before the Preliminary Notice is given and going forward. You should do so ASAP.
