We're a restoration company and we provided emergency services to the customer and completed the job, they received payment on Jan 19 of this year for our services and we have not been able to collect. Our mechanics lien has expired. Is that still something we can proceed with?
You have 90 days after recording the lien to file a lien foreclosure action. If that time has passed, you should still have claims for breach of contract that you can assert to recover payment in full for the labor and materials provided. You may also be entitled to recover your attorney's fees and 2% interest per month under the prompt payment statutes.
