Can we file a mechanic's lien?

We are a sub and we have not been paid for some change orders nor our retention. After emailing the GC several times, we received a response that they had already received the certificate of occupancy and that we would not get paid for the items mentioned above. Can we still file a lien? Is there a way to get our payment?

If a valid Notice of Completion has been recorded, you still have thirty days in which to record a valid Mechanics Lien. Many Notices of Completion are not timely recorded, so you may still have time to record a Mechanics Lien. If the time to record a Mechanics Lien has passed, you should still be able to pursue a breach of contract claim against the General Contractor. I suggest you consult with an attorney to discuss these matters in greater detail.
