This is a project that we have been working on since early 2019. We over shipped material and need to pick it up and there is a dispute with managers (mine and theirs) but invoice is still due. I am not sure what notices if any have been sent previously. Are we able to do anything to collect this invoice amount?
The answer, with regard to liens alone, depends on 1) when the materials were shipped to the project and 2) where your company falls in the chain of contract, e.g. GC, subcontractor, sub-subcontractor etc.
However, a lien is not your sole option in recovery of money owed for material provided. You may still recovery under several additional legal causes of action, and these claims to not depend on whether you have a lien. Basically liens are good security, but waiver of lien rights is not the end of the world.
