As an architect we worked with a client to design there project and end the project design entitled in Sunnyvale Ca. The client loves the design and the project is approved through the city. They have paid 85% of there bill however have not made a payment in 9 months now. Last week we found out they are trying to sell the land with the approved design plan. They tell us we will get paid as soon as they sell the parcel. We are concerned that once they sell the land they will dissolve the LLC and and we will not see the balance of the contract. Is it to late to put a lien on the parcel?
Did you file the 20 day preliminary notice back when you started the work?
If construction has not yet commenced (and may not commence), you may need to consider whether to file a design professionals lien. It may also depend on the nature and type of project, the estimated construction costs, and timing. You should speak to an experienced construction attorney ASAP to evaluate your rights.
If you have a contract with the owner and construction is not complete, it is not too late to file/record a lien.
