Can the contractor still fill a prelien in az

ArizonaLien Priority

Contractor sent a prelien letter after contruction started and a paid 24k of a 60k job. I sent the letter back saying that the prelien letter was incorrect total because I had already paid 24k of 60k. I also request them sign off on 24k progress payment. That was 2 months ago and within the 10days the lien company gave me for inaccurate information.

The only thing a preliminary 20-day notice does is give notice that a contractor has preserved its lien rights. It has no legal effect unless a mechanic's lien is recorded. If the information on the notice is inaccurate, that is much more the contractor's problem than it is yours. None of this really matters unless a payment dispute arises and the property is liened.
