Can someone file a mechanics lien after 30 days of work was completed in Arizona

ArizonaPreliminary Notice

I got a 20 day lien notice sent in to me and signed it disputing. The company never sent an actual bill to my house for services and billed me way more than the initial verbal agreement for the scope of work. I do not want to pay them the amount they are putting in this lien due to never having agreed to an amount above the money verbally agreed upon. They will not send me any contracts I have signed as I asked them for these. This looks like a very deficient lien but, I don't want to have it against my property. Can you provide any assistance?

The preliminary 20-day notice is just that - a notice. It is not a contract. So you did not need to dispute it. If your house is owner occupied residential, then they need to have a written contract with the owner before they can lien the property. It's not clear from what you wrote whether there is a written contract. On one hand, you refer to verbal agreements. On the other hand you are asking them to send you contracts that you signed. If there is a written contract, I can't give you an opinion without reading the contract and looking at whatever lien was recorded. And overarching all of this is whether there is enough money at stake to make it worth a fight. Feel free to email me if you cannot get the situation resolved. jab@jhc.law
