Can one use a cap for services in lieu of a formal estimate in an emergency services situation

Do you have an emergency restoration contract form? In NJ a construction contract requires an estimate. If a firm provides emergency services it is impossible to give an accurate estimate and if services are not rendered immediately smoke fair and water damages can become more severe. Can one use a cap for services in lieu of a formal estimate
