I am a owner builder and I was building with my mom boy friend and he is now trying to file a mechanics Lien when he does not have a contractors license nor did he file a Preliminary notice can he still out a Mechanics lean on my property
There is nothing stopping your Mom's boyfriend from recording a lien on the property. But most likely the lien would be invalid and unenforceable as assuming he did more than $500 worth of work and the work was construction work requiring a license, he is barred by B&P section 7031(a) from pursuing a claim for payment.
