Can my first notice ever to customer be a notice of lien?

I am a prime contractor and have given no notice for anything. Can my first notice ever to the customer be a notice of lien? (due to non payment before my 90 day period expires)

You are not required to send a notice to the owner if you have a direct contract with the owner. If your lien time is getting short file it without delay. You must send a copy to the owner within 15 days of filing. The copy does not have to show any filing information.

Presumably you have a direct contract with the owner. If Florida, a “notice of intent to lien” is not required for direct contracts. You should record your lien well before your 90 days are up. Contact a construction attorney to be sure you get all the lien details correct – a mistake will invalidate your lien.
