can I sue the licensed contractor who sponsored or hired an unlicensed contractor to perform the work at my house?

There is an unlicensed contractor who is currently performing the work at my house. At first, he told me he had the license. After I signed the contract, I found out that he used someone else's license and a licensed person sponsored or acknowledge about that. The licensed person came to my house about 2 times. I paid the unlicensed contractor for most of the services that were required on the contract. He stopped the work and I could not contact him for the last few days. Can I sue or go after both the licensed contractor as well as the unlicensed contractor for the recovery money that I paid? Can they file for bankruptcy? What should I do? Please advise. Thanks.

Hi, It is a misdemeanor offense in California to "rent" out your contractor's license to an unlicensed individual. If you signed a contract with someone who does not have a license, you may be entitled to the disgorgement of 100% of the money you paid, plus other damages. You may have claims against the licensed contractor, but you should speak with an experienced construction attorney about the specific facts of your case.

It sounds like you paid money to an unlicensed contractor for work that requires a license.

In that case, you can sue the unlicensed contractor to recover all amounts that you paid the unlicensed contractor.

If the licensed contractor caused you to make payments to the unlicensed contractor, you may have a claim against the licensed contractor.

If they meet the requirements to do so, the unlicensed contractor may be able to file BK.

The best way to recover is to file suit.
