Can I still submit mechanics lien?

UtahPreliminary Notice
Anonymous Contractor

I wasn’t very knowledgeable about the process to file a mechanics lien so I might have submitted the Preliminary Notice late. Can I still do it if it’s only a day over 20 days?

Yes. However, a preliminary notice filed more than 20 days after the commencement of your construction work will only attach to work that is provided 5 days after the preliminary notice is filed. If your work is complete or a notice of completion is filed, the preliminary notice will have no effect. Here is the statute that provides these rules: https://le.utah.gov/xcode/Title38/Chapter1A/38-1a-S501.html.
