Unfortunately, the answer is not clear. Governor Cuomo, in his executive orders extending various time frames (including statutes of limitations), did not specifically reference the extension of time frames set forth in the Lien Law. However, the language in EO 202.8 that references the extension of timeframes “by any other statute, local law, ordinance, order, rule, or regulation” is arbuably broad enough to toll the filing or extension of mechanic’s liens.
I know this is not the answer you are looking for (or much comfort), but what you may have here is a test case. Depending on the amount at issue, you may wish to undertake that test.
