Can I still file a mechanics lien

CaliforniaLien Deadlines

I’m a contractor in California, it’s with a property management company that I’ve worked with before, and I’ve always gotten paid. They’ve gone dark on this job and they won’t even return my emails, phone calls, messages. The job was completed in September so I’ve gone beyond the 90 days. Which doesn’t make sense to me because the first 90 days are negotiating and trying to work it out. Can I still file a mechanics lien on this job?

mechanics lien laws are very powerful legal tools for contractors and as such, the rules for the how and when mechanics lien can be used have strict consequences in order to be effective. Often, unscrupulous generals and upstream business partners purposely drag out negotiations in order to make contractors miss those deadlines. Once gone, it renders the mech lien ineffective and takes the threat of the mech lien away. Contractor then becomes another debt collector. that is why we recommend following the process as outlined by Levelset, each and every time, in order to protect your rights and keep you in the front of the line when it comes time to get paid. You still have other options to collect such as filing a breach of contract claim and other claims against the general , but the most effect tool is no longer available to you. contact a qualified attorney to see if it makes sense to do so.
