Can I send a preliminary notice for a project in Oregon when its supplier to supplier?

Oregon

We already sent a preliminary notice for this Oregon project but our customer informed us we don't have lien rights and need to retract the notices. I did a little research and found out we were given incorrect information such as who the general contractor is for this project. Our customer is a supplier and we are a material supplier. I did a double check and our material is being shipped to the job site. Do we have lien rights under the Oregon lien law or are we to far removed?

While it always a good idea to send preliminary notice on all of your jobs, this particular scenario isn't so cut and dry. As a supplier to a supplier, you're not likely to have lien rights on the property. Your best course of action at this point may be through litigation, although I'm sure that's not music to your ears. Here's some info to better understand the supplier-to-supplier relationship and why you're not likely to have lien rights. Sorry to deliver the bad news, good luck moving forward.
