Can I put a lien on the property

I painted a house in Maine, owner owes me 10k, doesn't paying. I didn't create the contract but he agreed to make me a check for 10k by phone text messages. Can I put a lien with proof of messages with him?

The short answer is yes. You will need to show your painting services were performed “by virtue of a contract with or by consent of the owner,” which the text messages should support. You should also be aware there is a requirement to file a notice of lien claim in the registry of deeds “within 90 days after ceasing to labor, furnish materials or perform services” unless “the labor, materials or services are furnished by a contract with the owner of the property affected.” Other statutory deadlines apply as well. This is a highly technical area and you would be well advised to consult with an experienced Maine attorney.
