Can I ignore a 3 year old mechanics lien - the company no longer exists

IndianaLien ForeclosureMechanics Lien

I had my basement finished in 2018. The main contractor sub contracted tile work in the new bathroom. He did not pay the sub so the sub put a mechanics lien on my property (I had know idea that was possible). The main told me back in 2018 that he was taking care of it and blamed the sub yada yada. I now am in the process of selling my house and notice this is still recorded. The company with the lien is no longer in business and I don't know how to get in touch with him. Since this has been over 3 years will this not effect me when I go to sell?

Give my office a call. 260-782-1712. In short, the sub had to have given you preliminary notice. If he/she didn't do that then it was improper for them to file the lien. Typically, unless renewed a lien is void after a year. If the sub did not give you notice of the renewal then its likely void. If it is being maintained improperly you can initiate a law suit to quiet the title and for slander of title. If you prevail you can get your attorney's fees paid as well as damages that the slandering of title caused. I look forward to speaking with you. Podlaski LLP Attorneys at Law. Best, Nick
