I own a residential HVAC company (I’m the sole employee), I want to begin doing new unit installations and only need assistance with the labor on a per job basis. Can I hire laborers/independent contractors that I provide a 1099 for after work is completed?
This is considered renting your license which is illegal in Florida. You cannot be an "independent contractor" performing work requiring a license without having a license yourself. Every one of your "1099" employees would be engaging in unlicensed contracting and you would be "aiding and abetting" unlicensed activitiy, which is grounds for discipline against your license. Do the right thing and hire them as W-2 employees or do the work yourself.
