Can I have a mechanic's lien dismissed if the company that filed it is no longer in business?

A mechanic's lien was filed against my property for $10,000 owed as balance for remodeling. The damage done by the remodeling company exceeds that cost by $1,100. It has been three years. The company is no longer in business. There has been no legal activity in approximately one year. The Clerk of Courts has recommended I file a Motion to Dismiss.

Assuming a lawsuit was filed against you, a Motion to Dismiss would be proper. If no lawsuit has been filed, the lien is void because it must be sued upon within one year from the filing date.
