Can I get my down payment back?

I have paid a contractor 22k for a down payment on a pool. No work has been performed as we are awaiting HOA approval. I have since decided I do not want to use this contractor and have verbally requested the payment be returned to me. I have a quote for the construction of the pool that I signed. There are no legal terms written into this quote nor is there any any verbiage detailing terms of a refund in the quote. The contractor is not returning my calls thus far. What are my options?

Wow, that's a tricky one b/c when parties sign a contract arguably you're under contract. Here, the question is unj. enrich't (if there is no contract)

If no work or planning has been done, you should be entitled to a return of your deposit, but the contractor may be entitled to recover a lost profit because you are breaching the contract. You can send a demand letter, potentially report them to the attorney general, report to the better business bureau, or file a lawsuit.
