Public Works project, State of Ca., my Counsel can confirm we have the Bonding Company served timely in a case where the GC simply did not pay. This GC represented he had not been paid, the work and he had not been accepted, when in truth, he had been both accepted and paid. In E-Mails, after he was cautioned not to talk to us without Counsel, he waived needing Counsel (in writing) and stated he had not used my company, rather, he had assumed he could pay me time and materials. When we received documents from the State of Ca, based on simple freedom of info inquiry, he had listed my hard bid and my company DIR license as well as my C-10 for electrical work. He has, in my view, committed fraud. I would like to fund the litigation externally as I am a micro small business and need to be situated to bid other projects and apply for financing if I win a larger project. This would help my company immeasurably. Given the State Statutes entitle me to legal costs and I had no issues on this job, no punch list and no call backs at all (no service in 1.5 years whatsoever) I felt someone should be engaged in litigation finance who would consider this kind of opportunity fundable.
