I am a HVAC contractor working on a new custom residential house. My portion of the work is about 99% complete. The home owner promised to pay me additional progress payment when the cooling portion was completed. When I told him to pay me the progress payment as promised before any additional work, he said I am fired.
Did you serve the preliminary notice of lien rights not later than 20 days after your first contribution of labor, services, tools, materials, fixtures, or machinery to the job site to the proper parties as required under the statutes? If so, yes, you can then serve and record a notice and claim of lien.
