Can I file lien in Canada?

Michigan

I have a project that was sold and installed in Canada. Is there any recourse we can take to get paid?

If you are looking for available remedies in Canada, you will need to contact an attorney licensed to practice in Canada.

If, on the other hand, the purchaser conducts business in Michigan or has assets in Michigan, then you can still sue for breach of contract in Michigan and seek to collect here.

Michigan’s statutory lien law will obviously not avail you in Canada. Can you elaborate on “… a project that was sold and installed [out of the country] …”? Lien law attaches to, and encumbers, real property to help a contractor, laborer, or arguably soft services that physically improved a property to get paid. Does the Project / Defendant(s) have any related real property in Michigan? Regards, John K. Robertson LAW OFFICE - CONTRACT ATTORNEY t: (248)943-7770 e: lawjkr@mac.com (TEXT FOR EXPEDITED RESPONSE)
