Anonymous Subcontractor

We are a subcontractor on a "public" job in Hawaii. The General Contractor was terminated from the job. Can we file a Stop Notice in Hawaii? Hawaii law is unclear if this mechanism is possible. Thank you, Patrick

Stop notices aren't a construction payment remedy in Hawaii. In fact, stop notices are only available in a small minority of states, as discussed here: What Is a Stop Notice & How Do They Work? If there's a payment bond present on the project, then making a payment bond claim could be useful for forcing payment. You can learn about Hawaii payment bond claims with this resource: Hawaii Bond Claim Guide and FAQs. Alternatively, threatening legal claims against your customer, actually pursuing claims (like breach of contract or a claim under the Hawaii prompt payment laws, as applicable), or sending the debt to collections might all be potential remedies.
