Can I file a Notice to Owner?

FloridaPreliminary Notice

We're a subcontractor in FL working on this project with a FL address and our customer is a GC based in KY. This contract is for a mock-up window/door replacement only. Do I file a Notice to Owner for this, or no, since it's only a mock-up? There is a contract with a price, and we've placed an order for the product and materials needed. Thank you!

A Florida Notice to Owner ("NTO") is required within 45 days of first furnishing labor or materials to the project. So, if you haven't begun providing any work or supplies to the project site, then the clock has not begun on that deadline. Still, it can be useful to send notices a bit early, and nothing in Florida's mechanics lien statute seems to prohibit sending a Notice to Owner a little early, either. The deadline for sending Notices to Owner is strict - so it's crucial to keep an eye on that date. But, it's pretty common for a sub or supplier to send their NTO once they've got a signed contract and have begun securing materials for the job.
