Can I file a Mechanics Lien without sending a Prelim Notice?

There is a client whom we would like to send a Mechanics Lien but a Preliminary Lien Notice was never sent and we are past the 20-day timeframe; can a Mechanics Lien still be sent?

Yes. It just won't apply to any work done 20 Days prior to it being served.

You don’t need to send a preliminary notice if you have a direct contract with the owner of the property and if there is no lender. You still need to file your lien within 90 days of completion of the project (assuming there’s no Notice of Completion/Cessation recorded). So you may still have time depending on where you are on the project. I’m happy to answer any questions you have about this.
