Can I file a mechanics lien without a pre-lien?

My GC and I had an argument. Now he is not paying me for work performed.

A subcontractor has 20 days after commencing performance to submit the preliminary notice which will protect the subcontractors lien rights. This notice can be submitted any time thereafter, but it only protects lien rights commencing 20 days and on from when it was submitted. If it's beyond the 20 days then the contractor can file a breach of contract lawsuit against the general contractor instead of filing a mechanics lien.
