Can I file a mechanics lien in KY for a customer making payments?

We did a small construction job on a personal residence and the lady decided she wants to only pay $50 a month on a $1500 job. It would take 2 .5 years to pay off the invoice. Is it possible to still file a lien?

If you are not willing to take payments, you could file a lien, assuming, of course, that you file it timely. You would then have to file suit on the lien within 1 year following the lien filing.

If you are willing to take payments, you should have a financing agreement with the homeowner which provides for interest and collection costs.

Hello,

We have already received 2 - $50.00 payments. Customer said we can't file a lien if she's making monthly payments. I just wanted to verify that she isn't correct. Thanks

Under KRS 376.220, it is limited to the unpaid balance when filed. I couldn't even guess where she got the idea that monthly payments somehow void a lien.
