Can I file a Mechanics Lien in CA

CaliforniaMechanics LienPreliminary Notice

We are a general contractor doing work in CA and we did not file the Reqd Preliminary Notice. Are we still able to file the lien (21-029-2086 Save Mart 93)

It depends on various facts. What is the status of the project? Is there a construction lender? Is this a tenant improvement? You should consult with an experienced construction attorney to discuss your rights and obligations.

Depends. If you are a direct contractor or, in some circumstances, there is an independent relationship and the owner is aware of your involvement, then you can lien without a preliminary notice. A consult with a lawyer is recommended as the time deadlines are statutorily driven.
