can I file a mechanics lien

CaliforniaLien DeadlinesMechanics LienRight to Lien

Im a subcontractor working on a residential project. We finished nearly all the work and the customer had us stop work at the kitchen so he could install new cabinets (7 day break), he paid the majority of the bill at that time, leaving $1300 left until after we returned to finish the kitchen. After we finished the kitchen he will now not return any calls, emails, or texts. Also already sent preliminary notice and intent to lien.

In California, a subcontractor is allowed to file a lien within 90 days from the completion of the project as a whole, provided the required preliminary notice was provided. However, if a notice of completion or cessation was filed, the deadline is shortened to 30 days from the date such notice was filed. If the notice was provided, a mechanics lien can generally be filed to help shake payment loose. Everybody wants to avoid their property being sold, so mechanics liens are very powerful tools to get people paid. Filing a lien is a process that requires specific adherence to rules and requirements in order for the lien to be valid and enforceable. Not only do the deadlines above need to be met, there are also form requirements, filing requirements, text/content requirements, and more. You can see a step-by-step guide to California's lien filing process here. Or, you can make the process quick and easy by taking care of it electronically, here.
