can i file a mechanics lien

Our work was completed in November 2020, am I able to still file a mechanics lien on this project? No payments have been received.

The deadline for recording a mechanic's lien is not dependent on when you complete your work (if you are a subcontractor) but when the project is completed. Unless a valid notice of completion is recorded, the deadline for recording a mechanics lien is 90 days from the date of completion of the project. If a valid notice of completion is recorded, the deadline for subcontractors and materials suppliers not in direct contract with the owner is reduced to 30 days. I suggest you consult with an attorney who knows the mechanics lien law to review your specific situation.

Thank you so much for the quick response. This is very helpful, I never received a NOC so I believe we are good. We are a subcontractor for a GC, so I will need to move on this right away.

I would not rely on the fact that you have not received a Notice of Completion. Check the County Recorder's office to see if a Notice of Completion has been recorded.
