Can I file a mechanics lien?

WisconsinMechanics Lien

I was sued in small claims for a project I didn't finish. My client fired me due to Covid delays. The judge ruled in her favor. I feel she took advantage of our agreement. Can I still file a lien if the judgement was against me?

In Wisconsin, a mechanics lien may be filed if contractors and suppliers don't get paid on a construction project that improved the property. In Wisconsin, every person who furnishes labor or materials for the erection, alteration, repair, or improvement of a building or structure is entitled to a mechanics lien - regardless of their tier on the project. In Wisconsin, a potential lien claimant must file a mechanics lien within 6 months after the last day on which labor and/or materials were furnished to the project, but at least 30 days after the filing of a Notice of Intention to File a Claim of Lien. The lien must also be served on the property owner within 30 days of the filing of the lien.

It is important to keep in mind that mechanics lien rights are only available to qualifying parties when the lien deadlines are met. You may find a step-by-step guide on how to file a Wisconsin mechanics lien here!
