Can I file a mechanics lien?

California

I sent a notice of intent to lien to the owner that expires today, according to Levelset but have not heard back. What is our rights or procedure shall we do at this point?

Absent a notice of completion being recorded, you have 90 days from Project completion to record a lien. You are eligible to record a lien in you have a direct contract with the owner (and there is no construction lender) or if you gave preliminary notice (prelien notice) within 20 days of commencing your work. Once a lien is recorded, you have 90 days from the date of recording to file a lawsuit to foreclose the lien. In the interim sending a demand letter reinforcing your intent to foreclose the lien is recommended. This letter may be more effective coming from an attorney.
