I'm a electrical contractor(owner) who recently assessed a customer project, provided a estimate and scheduled a appointment with the customer for service. The customer signed the contract and agreed to provide a down payment in the amount of $4700.00 in check form and refused to pay the dispatch fee in the amount of $29.99. A few days later the customer canceled the scheduled appointment and demanded the check down payment be returned. My office scheduled the drop off of the check in the amount of $4700.00 dollars and confirmed the check was delivered and cashed! The problem here is the customer check bounced and my check cleared without issue. Can I submit a claim for a mechanics lien without issue since this is a valid contract, materials were purchased and funds was exchanged that negatively impacted the business due to service.
