Can I file a Mechanics Lien?

Colorado

I have 2 issues, 1 homeowner refuses to pay and threaten that if I pursue with Lien she would sue. 1 company we did subcontract work refuses to pay on 2 invoices, and now has come back with back charges on work that had already been paid and completed. Also threaten to go to Alabama Dept of Insurance.

For the first issue, you basically have to make a choice. Do you believe she would sue or not? We can't say what will happen, but it is a common claim that is made and many times there is no lawsuit. For the second issue, if this subcontract was for work in Alabama then you should reach out to an attorney in that state. If this is for work in Colorado and under a written agreement (I hope you had this) under Colorado law, you can file a lien for the amount due. Your construction attorney would also consider disburser notices and demands under the trust fund statute. Again, this relates to Colorado projects under CO law. If this is some other state, contact an attorney in that state.
