Can I file a mechanics lien

Hi there. I performed an inspection for a contractor that was working a federal contract to remodel the US States Attorney Office in Beaumont Tx back on 3-31-21. The contractor owed me $1850 for the inspection and has still refused to pay. I’d very much like to get this payment and it’s needed being how I’m a small veteran owned business that can’t take a loss like that.

Hello,

A couple different things.

1. Your matter, because it touched and concerned a federal project, falls under the Miller Act.
2. You may have missed your deadline to send notice to the original contractor. You have 90 days from the last day work was performed under the contract. Do some counting because your deadline is either coming or has passed already.
3. You may not be considered Labor under the Miller Act. It will depend on the contract and the work you did. You're going to want someone to evaluate your condition more specifically.
