Can I file a mechanical lien?

I have not been paid mywages for 7 weeks. I work for a building contractor developing condos. This is a private project. #1. Am I able to file a mechanical lien? #2. There are other laborers in my same situation. If able do we file separately or as a group?

In answer to your questions -- 

(1) Yes. A laborer who provides an improvement to real property has a construction lien under Section 107(1) of the Michigan Construction Lien Act. LevelSet can help you prepare and record your lien.

(2) I recommend that each laborer file their own separate construction lien.  

Down the road, if the contractor won't pay you, and you have to file a lawsuit, I think you and the other laborers could proceed together as a group (Co-Plaintiffs). Each of your individual claims would be a separate count in the lawsuit. This also assumes that you and your fellow laborers each worked on the same condos.
