We are a GC on a project in AZ and are having problems collecting our retention payment for this project. We did not file a 20 day notice, can we still file a mechanic's lien? The owner we are contracted with did have a lender on the project, but has recently sold the property. Please advise
I am sorry for the issues. No, you may not file a lien if you have not served the 20-day preliminary notice. The notice is a condition precedent to a valid lien.
