Can I file a mechanic lien?

I finished a residential painting job. The customer does not want to pay. He is unwilling to talk to me.

To have mechanic's lien rights, you would need to have sent a preliminary 20-day notice and if the residence is owner occupied, you need a written contract with the owner. Assuming you do not have mechanic's lien rights, that does not mean you are not owed the money for the work you did. You can still file suit against the homeowner for breach of contract or unjust enrichment (assuming you are a licensed contractor). Whether a lawsuit is worth it depends on the amount of money owed and any defenses the owner might have. But it sounds like if the owner is simply ignoring you a lawsuit may be your only alternative because a lawsuit is the only thing the owner cannot ignore.
