Hello, I am a specialty subcontractor on a public school project (specifically housing on a community college campus) and the GC has stopped making payments to us. If we are a subcontractor to a GC, the project is public and owned by the community college district, can we still file a mechanics lien for non-payment? Thank you!
There are some prompt payment laws that can help you out here, but their application can be quite fact specific. But, to answer your question, no you would not file a lien. There will be a bond on the project which you can file again instead though. A construction attorney familiar with public agency construction can help you with your options in a situation like this which may include: (1) bond claims, (2) stop notices, and (3) breach of contract claims.
