Can I file a lien on this project?

CaliforniaCollections

Im a sub on working on a large commercial project. I finished my work on the job in March but haven't gotten paid. My customer is giving me a run around and never gives an update regarding payment. What should I do?

Your options are to file a lien assuming you did the preliminary paperwork or to file a breach of contract lawsuit. You have to file the lien within 90 days the job being completed or within 30 days after a notice of completion has been recorded. A breach of contract lawsuit is just that, you had a contract, you did the work, and you didn’t get paid. If the general contractor goes bankrupt, even if you win the breach of contract suit you’ll have a hard time collecting. That’s why liens on the property are nice.
