Can I file a lien, if so what kind?

TexasMechanics Lien

What type of lien do I need to file? I am a landscape contractor who had a direct written contract/agreement with the property owner. Project was finished on 9/03/2021, I had no response from owner/customer when trying to collect. Customer finally emailed me on 9/09/2021 saying job did not meet her expectations. Everything was completed per contract, we offered her small discount to get her to pay. And she still refuses. Can I file a lien, if so what kind? , are there notices i need to send out prior to the actual lien?

I am assuming that the project is a home. If. not, some of this answer could change.

You have the right to file a mechanic's lien on the property BUT only if you have a written contract. A proposal signed by the owner is sufficient. Because you have a contract with the owner, you do not have to send a notice before you file the lien. However, you should contact her and tell her if this. is not resolved by (within ten days) you will file a lien. If she offers you a reasonable amount to settle your claim, it would be a good idea to take it.
