Can I amend the claim amount on a NUB in New Jersey?

We shipped material for a project on 2 lots, they GC never paid us. We filed a NUB for the total amount on one lot but we need to change the amount to 50% on lot A and set up a new case and file for 50% on lot B.

Great question! Unlike some other mechanics lien statutes out there, the New Jersey lien statute does a good job at providing for circumstances where a document may need to be amended. Under § 2A: 44A-20(h) of that statute, "A Notice of Unpaid Balance and Right to File Lien may be amended by the filing of an Amended Notice of Unpaid Balance and Right to File Lien in accordance with this section." Thus, as long as the deadline to file a Notice of Unpaid Balance hasn't passed, and as long as the requirements for filing a Notice of Unpaid Balance are followed, a Notice of Unpaid Balance can be amended.
