Dispute with fencing company, they measured inaccurately and then dug up and moved fence. I initially refused to pay balance and filed small claims. Received notice from their attorneys to make payment within ten days if not they would go to court and file to force a foreclosure on my home if I took the case to trial. I paid within the 10 days but received another notice stating they would cash my payment if I paid part of their legal fees. They have been holding the cashier's check for over 60 days and insisting on going to trial to force foreclosure and dismiss my small claims. I now have to hire an attorney, after they filed a motion to transfer from small claims to civil court.
