Can any stranger contractor or firm file mechanics lien regardless of the property owner consent to the work performed

I am a property owner of an apartment building in Illinois, one day i got a Notice of Intent to File Mechanics Lien When i called the company who send the letter, they said they provided board up service to one apartment, but they don't have any documentation of the service agreement or contract. I have no idea about this work being performed, I never consented to the work performed neither written nor verbal. Can the contractor still proceed to file the lien? If that is the case, can any stranger perform work whether requested or not, and file lien to be payed for it in Illinois?

The short answer to your question is "No." A stranger cannot simply lien property when he has no agreement with the owner of the property to do the work. That said, anybody can file a lien. You may then move to dismiss it, and are entitled to $2,500 for the trouble. Speak with a knowledgable Illinois construction lawyer to learn more: but this should not be an issue.
