Can an equipment supplier/rental company file a mechanics lien in the state of Idaho?

We are an equipment supplier providing rental equipment for a client that is gold mining in ID. They are using it as support equipment at the mine on the surface, to help support the underground mining operations at the site, moving material, equipment, structures, moving material into the mill and around other desired locations on the surface. Do we have lien rights?

Idaho's mechanics lien statute provides broad mechanics lien rights for those who provide labor, materials, or equipment used in the construction, alteration, and repair of mining claims. So, yes - generally, those who supply equipment used for mining site operations will be entitled to Idaho mechanics lien rights.  To be certain, § 45-501 of Idaho's mechanics lien statute states that furnishing materials to a mining claim will give rise to lien rights. And, it also states that "furnishing material" includes "renting, leasing or otherwise supplying any equipment, materials, fixtures or machinery to any mine or mining claim."
