Can an electrical apprentice file a mechanics lien on my property? He was not overseen by any licensed individual.

I paid an unlicensed contractor under the false pretense that they were licensed. This fraudulent contractor hired (subcontracted on his own authority) his friend to do the electrical work. The electrician is a licensed electrical apprentice, can this electrician file a lien against my property if he lies and says his friend didn't pay him? I did pay the contractor in excess of the work that he performed and am now in the process of trying to pursue civil litigation and criminal charges in order to get a reimbursement for some of the job. No proper permits were pulled and the city issued a stop work order on the renovation and the contractor disappeared.

this is a tough question and might take some research but if the electrical work was done without proper permits its likely you will have a defense to the lien. In any case, good luck collecting from the unlicensed contractor. BTW Did you make a complaint to the State of Michigan occupational licensing division about the unlicensed contractor and the fact that a "licensed" apprentice was working for the unlicensed contractor.

Assuming the building is your residence, a valid lien must be supported by a written contract with licensed contractor signed by you. Not sure what a licensed apprentice is! I thought apprentices had to work with a licensee. You should monitor your county's Register of Deeds website to see if a lien gets filed. If one does get filed you are supposed to get a copy by cert mail. If so contact a construction attorney immediately to see what your options may be. oh a friend of mine also has this problem but he has not had anyone to help, maybe i will remind him to come and listen to everyone's share. Thanks for this information Slope 2 unblocked
